Account creation and customer responsibilities

By creating an account or placing an order with Daily Skin by Somalogic, you agree to these Terms of Service and confirm you are at least 18 years old. You're responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Please notify us immediately of any unauthorised use or security breach by emailing store@dailyskin.co.za.
When registering, you must provide accurate, complete, and current information. For professional-grade products requiring consultation questionnaires, you must answer all health and skin-related questions truthfully to ensure product safety and suitability. Providing false information may result in account termination and could pose serious health risks. We reserve the right to refuse service, cancel accounts, or remove content at our discretion if these terms are violated.

Product information and professional products

While we strive for accuracy in product descriptions, images, and ingredient lists, we cannot guarantee that all information is error-free or complete. Product images are for illustrative purposes only and actual products may vary slightly in appearance, packaging, or design from those shown on our website. We may substitute products with updated packaging or formulations while maintaining the same quality and efficacy.

Professional skincare products marked with our consultation badge require completion of a detailed questionnaire before purchase. These products contain active ingredients that may not be suitable for all skin types and require proper assessment by our skincare specialists. Products are subject to availability, and we reserve the right to limit quantities, discontinue products, or modify prices with reasonable notice.

Order acceptance and payment terms

Your order constitutes an offer to purchase products under these terms. We reserve the right to refuse or cancel orders for any reason, including suspected fraud, unauthorised transactions, or pricing errors. Order confirmation emails acknowledge receipt but don't constitute acceptance - acceptance occurs only when products are dispatched, at which point a contract is formed between us.

Orders cannot be modified once placed as they process quickly through our fulfilment system. If you need to make changes, you must attempt cancellation before 14:00 on the day of ordering and place a new order.

Payment is processed exclusively through PayFast using electronic payment methods - we do not accept cash on delivery. All prices are displayed in South African Rand (ZAR) and include VAT where applicable. You authorise us to charge the total amount including products, shipping, and any applicable taxes to your selected payment method. If payment authorization fails, your order will be automatically cancelled and you will need to place a new order with valid payment details.

Intellectual property and content usage

All content on dailyskin.co.za, including text, images, logos, and product descriptions, is the property of Somalogic or our suppliers and protected by South African and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission. The Daily Skin and Somalogic trademarks and trade dress may not be used without authorization.

You grant us a non-exclusive, royalty-free license to use any content you submit (such as reviews or testimonials) for marketing and promotional purposes. By submitting content, you confirm it's original, doesn't infringe third-party rights, and doesn't contain harmful or illegal material. We reserve the right to remove any user-generated content at our discretion.

Limitation of liability and indemnification

To the maximum extent permitted by law, Daily Skin by Somalogic shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or services. Our total liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim. These limitations apply regardless of the legal theory under which damages are sought.

Governing law and dispute resolution

These Terms of Service are governed by the laws of South Africa, and you consent to the exclusive jurisdiction of the courts in Pretoria for any disputes arising from these terms or your use of our services. Before initiating legal proceedings, you agree to attempt resolution through good faith negotiation by contacting our customer service team.

Any disputes not resolved through negotiation within 30 days may be submitted to binding arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA). The arbitration will be conducted in Pretoria, with proceedings in English, and the arbitrator's decision will be final and binding. Each party bears their own costs unless the arbitrator determines otherwise based on the merits of the case.
